Registered post with acknowledgement due remains the standard, because the postal record is accepted proof. Send by email as well where you have an address on record. Keep the receipt, the tracking printout and the returned acknowledgement — service is what gets attacked first.

Be precise about dates and figures

Vague notices invite vague replies. State the date of the agreement, the dates of breach, the exact amount claimed and how interest is calculated. A notice that reads like a pleading is far harder to brush off.

Watch the statutory notices

Some notices carry fixed statutory periods and cannot be adapted from a general format — Section 138 of the Negotiable Instruments Act, Section 80 of the Civil Procedure Code for suits against government, and eviction notices under state tenancy law each have their own requirements.

Frequently asked questions

Can I send a legal notice myself, without an advocate?
Yes. A notice from the party is valid. One drafted and issued by an advocate on the party’s instructions generally carries more weight and avoids errors of substance.
How long should I give for compliance?
Fifteen to thirty days is usual for a general demand. Where a statute prescribes a period — such as the fifteen days under Section 138 — that period governs.
What if the notice is returned unclaimed?
Refusal or non-collection is generally treated as good service, provided the address is correct. Preserve the sealed envelope with the postal endorsement intact.
Does sending a notice extend the limitation period?
No. A notice does not stop or extend limitation. Only the circumstances set out in the Limitation Act do.
