Why eleven months

Agreements of twelve months or more attract compulsory registration under Section 17 of the Registration Act, 1908, along with higher stamp duty. The eleven-month term is a long-standing way of avoiding that, though it does not confer any special legal status.

Stamp it properly

An unstamped or under-stamped agreement is not admissible in evidence under Section 35 of the Indian Stamp Act. Rates vary by state and are usually a percentage of annual rent plus deposit. Getting this wrong makes the document useless in exactly the situation you need it.

The deposit clause is the one to negotiate

Most disputes at the end of a tenancy are about the deposit. Fix the refund period in days, require itemised deductions in writing, and record the condition of the property with dated photographs at handover.

Frequently asked questions

Does a rent agreement need to be registered?
Leases of twelve months or more require registration under Section 17 of the Registration Act, 1908. Agreements of eleven months are commonly used to avoid that requirement.
Is a notarised agreement the same as a registered one?
No. Notarisation only attests signatures. Registration creates a public record and is what the law requires for leases of a year or more.
What if the landlord refuses to return the deposit?
Send a written demand setting out the amount and the handover date. If unresolved, the remedy is a civil suit for recovery, or the rent authority where your state’s tenancy legislation provides one.
Can rent be increased during the term?
Not unless the agreement provides for it. Any escalation should be written in, with the percentage and the date it applies.
