A legal heir certificate is issued by the revenue authority and is used for pensions, provident fund, gratuity and transfer of records. A succession certificate is granted by a civil court under the Indian Succession Act and is what banks and companies require for debts and securities. They are not interchangeable.

Expect an inquiry

The revenue authority typically conducts a local inquiry through the village administrative officer before issuing the certificate. Processing commonly takes 30 to 45 days, longer where an objection is raised.

Where heirs disagree

If any heir disputes the list, the revenue authority will not resolve it. The matter has to go to the civil court, either as a succession certificate petition or as a suit for partition and declaration.
