An NOC that simply says ‘no objection’ without identifying the purpose is often returned. Name the specific act, the authority it is being submitted to, and the property or person concerned.

An NOC is not a waiver of rights

Include a line confirming that the certificate does not transfer any right or interest. Without it, an NOC can be pressed into service later as evidence of something broader than intended.

Some NOCs have prescribed forms

Frequently asked questions

Is an NOC legally binding?
It binds the issuer to the extent of the consent given. It does not create rights beyond that, particularly where the certificate expressly says so.
Can an NOC be withdrawn?
Generally not once acted upon, because the recipient has relied on it. Consent given for a specific purpose does not extend to other purposes.
Does a landlord’s NOC need to be on stamp paper?
Usually not for GST or Shops and Establishment registration — plain paper with the owner’s signature and address proof is normally accepted. Requirements vary by authority.
What if my landlord refuses to give an NOC?
Check the rent agreement. Where it permits business use, the agreement itself may satisfy the authority. Otherwise it is a matter of negotiation.
