Adding versus extracting

Adding GST is straightforward: multiply the taxable value by the rate. Extracting it from an inclusive price is where errors creep in, because people deduct the rate from the total instead of dividing.

For an 18% inclusive price, the taxable value is the total divided by 1.18, not the total minus 18%. On a ₹1,18,000 invoice that is the difference between ₹1,00,000 and ₹96,760.

CGST, SGST and IGST

A supply within a state attracts central GST and state GST in equal halves. A supply between states attracts integrated GST at the full rate, collected by the Centre and apportioned.

Place of supply determines which applies, and for services it is not always where the supplier sits. Getting this wrong means paying the tax twice and claiming a refund for the wrong one.

Unpaid invoices with GST already discharged are a common commercial dispute — the supplier has paid tax to the government on money never received. Section 34 credit notes and the conditions for reversing that liability are worth understanding before writing off a debt.

Which rate applies to my product?
It depends on the HSN code for goods or the SAC code for services. The rate schedules are notified and updated periodically — check the current notification rather than relying on memory.
Do I charge CGST and SGST or IGST?
It turns on the place of supply. Same state as the supplier means CGST and SGST; a different state means IGST.
Is GST payable on a legal notice or advocate’s fee?
Services by an individual advocate to a business entity generally fall under reverse charge, so the recipient pays. The position varies with turnover and the nature of the recipient.
Can I recover GST from a customer who never paid the invoice?
The tax is payable on supply, not on receipt. A credit note under Section 34 can reverse the liability in limited circumstances and within a time limit.
