Compensation in a fatal motor accident claim is not arbitrary. The Supreme Court set out a structured method in Sarla Verma and refined it in National Insurance Co. v. Pranay Sethi (2017): annual income, plus a percentage for future prospects, less a deduction for the deceased’s personal expenses, multiplied by an age-based multiplier, plus fixed conventional heads.

The multiplier method, step by step

Start with the deceased’s established annual income. Add a percentage for future prospects — 50% for a person under 40 in permanent employment, 30% between 40 and 50, and 15% between 50 and 60, with lower figures for those on fixed wages or self-employed.

Deduct the deceased’s own living expenses: one-half where there is a single dependant, one-third for two to three, one-fourth for four to six, and one-fifth beyond that. What remains is the annual contribution to the family.

Multiply that by the age-based multiplier from Sarla Verma — 18 at the top of the scale, falling with age. Then add the conventional heads: funeral expenses, loss of estate and loss of consortium, which Pranay Sethi fixed and directed to rise by 10% every three years.

What changes the number in practice

Proof of income is usually the largest variable. Income tax returns, salary slips and Form 16 carry weight; an unsupported claim about business income often does not. Where income cannot be proved, tribunals fall back on notional figures that are far lower.

Contributory negligence reduces the award proportionately. If the deceased is found 25% responsible, the compensation drops by a quarter.

Interest is awarded from the date of the claim petition, so delay in filing costs money even when the claim succeeds.

Injury claims work differently

This calculator addresses fatal claims. Where the victim survives with permanent disability, compensation is assessed on loss of earning capacity — the disability percentage applied to income and multiplier — together with medical expenses, attendant charges, pain and suffering, and loss of amenities.

There is no time limit for filing a claim petition under Section 166 of the Motor Vehicles Act, but delay weakens evidence and postpones interest.

Frequently asked questions

Is there a deadline for filing a MACT claim?
The limitation period was removed by amendment, so a claim petition under Section 166 can be filed without a fixed time bar. Delay still hurts — witnesses become harder to trace and interest runs only from the date of filing.
What if the offending vehicle was uninsured or untraced?
Claims involving untraced vehicles are dealt with under the Solatium Scheme, and claims against uninsured owners proceed against the owner personally. Recovery is harder, which is why the insurer’s presence matters.
Does a compromise with the insurer close the claim?
A settlement recorded before the tribunal is generally final. Take advice before accepting one — early offers are often well below what the multiplier method produces.
Can a claim be filed where the accident happened outside my state?
Yes. A claim may be filed where the accident occurred, where the claimant resides or carries on business, or where the respondent resides.
